GMB accuses Marks & Spencer of “unfair dismissal”


The GMB union will represent another sacked Marks & Spencer (M&S) worker, who it claims was unfairly dismissed.

According to the union, Nery Clark was sacked after attempting to use a friends and family discount card without realising the retailer had changed rules concerning the benefit.

GMB said M&S has given no evidence of previous incidents and also rejected Clark’s claim that she was unaware of any alterations to the rules.

Legal officer Maria Ludkin commented: “The case of Nery Clark shows how far M&S have moved from being a caring employer.

“GMB plans to take up the case of Nery Clark. GMB is also investigating ways to establish the extent of corporate bullying of M&S employees throughout the company.

“It is now clear that M&S employees need the protection of an independent trade union.”

GMB represented Tony Goode in August after he was sacked by M&S for revealing to the press changes in the company’s redundancy package.

He unsuccessfully appealed against the decision in October.
